Héctor Scaianschi

Introduction

Hector is a lawyer graduated from the Faculty of Law and Social Sciences, of the University of Republic (2006). He did a Master´s in Business Law at the University of Alcalá in Madrid, Spain (2008/2009) and is currently in the final stage of the preparation of his doctoral thesis to obtain the degree of Doctor of Laws in 2015. Moreover, he was appointed as Visiting Researcher at the Institute for Advanced Legal Studies, University of London (2012) and the Peace Palace Library in The Hague, Netherlands (2013), as well as Visiting Professor of the Giner Program Rivers University of Alcalá over the elective years 2010/2011 and 2011/2012. He has taken postgraduate courses in private international law at the Hague Academy of International Law in The Hague, Netherlands (2013) and International Business Law at the Complutense University of Madrid, Spain (2009).

In addition to this, he is a candidate for Adjunct Professor in the Faculty of Law of the University of the Republic and is the author of several specialized legal publications. To date, he is a member of the British Institute of International and Comparative Law and the Bar Association of Uruguay.

He has developed an important activity in the area of complex litigation, arbitration and insolvency proceedings. In this regard, we highlight his participation as a representative of AES Uruguaiana Emprendimientos SA and Companhia de Gas do Estado do Rio Grande do Sul in the ICC arbitration case No. 16232/JRF against YPF SA were claims involved an amount of approximately two billion dollars. Between 2006 and 2011 he was a member of the team which counseled the Central Bank of Uruguay regarding more than 200 lawsuits which amounted to more than 200 million dollars, promoted by national and foreign investors of Banco Montevideo, entity which was liquidated as a result of the banking crisis of 2002. Nowadays, he provides legal counsel to the Bank of Nova Scotia in the bankruptcy proceeding of the Uruguayan airline Pluna Lineas Aereas SA regarding a verified credit amounting to more than 100 million dollars.

Hector has also developed an intense activity of corporate advice to local and foreign clients focused on financing operations. In this sense he recently advised the group Chevron Corporation in relation to the granting of guarantees under the Uruguayan law under the Investment Agreement between Chevron Corporation and the state oil company YPF Argentina; Deutsche Bank and Bank of Tokyo Mitsubishi in the loan of up to US $ 137.5 million awarded to TOLMAR Holding Inc, and The Bank of Nova Scotia regarding the granting of a loan of US $ 50 million for the state oil company ANCAP for the purchase of hydrocarbon.
